Terms of Service
Last updated
These Terms of Service (“Terms”) are an agreement between you and Schokr, Inc. (“Schokr”, “we”, “us”), a California corporation at 333 W San Carlos St, San Jose, CA 95110, United States. They apply to schokr.gg, the Schokr console, our APIs, the Pterodactyl panel we provide, our documentation and any other service we offer (together, the “Service”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.
1. Who can use Schokr
- Age. You must be at least 13 years old. If you’re under 18, you need permission from a parent or guardian to use the Service, and they must agree to these Terms on your behalf before you make any purchase.
- One account per person. Each person may have only one Schokr account. Creating, buying or using additional (“alt”) accounts, including to collect free resources, rewards or referral credits more than once, isn’t allowed.
- Accurate information. You must give us accurate information and keep it up to date.
- Legal eligibility. You can’t use the Service if you’re barred from doing so under the laws of the United States or the country you live in.
2. Your account and team
- You’re responsible for your account. Keep your password, SFTP password and API keys secret. You’re responsible for everything that happens under your account and your teams, including actions by people you invite.
- Teams. Team owners are responsible for who they invite and what permissions they give. Team members can see some information about each other, as described in our Privacy Policy.
- Tell us about misuse. If you think your account has been accessed without permission, change your passwords and contact us at legal@schokr.gg.
3. The free service
Schokr gives every team a free package of resources. We want it to stay free, so:
- Limits can change. We may change the free package, resources, locations, features and prices at any time. Where a change significantly reduces what you’ve paid for, we’ll give you reasonable notice.
- No guaranteed uptime. We work hard to keep the Service running, but we don’t guarantee it will be available, uninterrupted or error-free. There’s no service-level agreement unless we sign one with you in writing.
- Fair use. Resources are shared. We may limit, pause or move servers that put unreasonable load on our infrastructure or affect other users.
- Coming-soon and beta features. Features we label as coming soon, preview or beta (such as virtual machines and databases) may change, have limits, or be withdrawn.
4. Credits
Credits are a virtual balance used inside Schokr to buy upgrades and features.
- No cash value. Credits aren’t money, have no cash value and aren’t your property. They can’t be exchanged for cash, refunded (except where the law requires it), or sold, traded or given to anyone outside of your own Schokr teams.
- Earning credits. Credits you earn from daily rewards, staying active, referrals or promotions are subject to the rules we publish. We may change how credits are earned and how much things cost at any time.
- Abuse. If we believe credits were earned or obtained through abuse, automation, alt accounts, exploits, chargebacks or any breach of these Terms, we may remove those credits, reset balances, lock economy features or suspend accounts.
- Upgrades. Upgrades bought with credits are added to your team’s resources and are not transferable outside the team.
5. Payments
- Stripe. Payments are processed by Stripe. By paying, you also agree to Stripe’s terms. We never see or store your full card details.
- Prices and taxes. Prices are shown at checkout in US dollars and may change. You’re responsible for any applicable taxes.
- Credit purchases are final. Purchases of credits are non-refundable, except where required by law. If you think you’ve been charged in error, contact us at legal@schokr.gg before disputing the charge.
- Chargebacks. If you dispute a payment with your bank instead of contacting us, we may suspend your account and remove the related credits or upgrades while we investigate.
6. Schokr One
Schokr One is an optional paid membership.
- Price and renewal. Schokr One costs $7.99 per month, or the price shown when you subscribe. It renews automatically every month and you’ll be charged each month until you cancel.
- Cancelling. You can cancel at any time from your account in the Schokr console, or by emailing legal@schokr.gg. Cancellation takes effect at the end of your current billing period. You keep your benefits until then.
- Refunds. Monthly fees aren’t refunded for partial months, except where required by law.
- Benefits. Benefits currently include a boost to AFK earnings, a custom profile tag and badge, unlimited snapshots and unlimited port allocations. We may change benefits. If we make a change that materially reduces them, we’ll tell you in advance and you can cancel before it applies.
- When membership ends. Member-only benefits stop when your membership ends. Your custom tag and badge may be removed, and features beyond your plan’s normal limits may stop working until you re-subscribe or bring your usage back within those limits.
- Price changes. We’ll give you notice before any price increase applies to your membership, and you can cancel before it takes effect.
7. Acceptable use
You may not use the Service, or let anyone else use it, to:
- Break the law or help anyone else do so, including hosting illegal content or content that infringes anyone’s intellectual property.
- Mine cryptocurrency or run other workloads designed to use as much compute as possible.
- Attack or abuse others, including denial-of-service attacks, stress testing or “booter” tools, port scanning, brute-forcing, exploiting vulnerabilities, or hosting malware, botnets or command-and-control servers.
- Send spam, phishing or unsolicited bulk messages, or run open mail relays.
- Run public proxies or VPNs, or tools designed to hide abuse or evade bans.
- Distribute pirated software, games or media, or cracked servers and plugins.
- Host content that sexually exploits minors, promotes violence or terrorism, or harasses, threatens or doxxes people.
- Abuse Schokr itself, including:
- creating or using alt accounts;
- using scripts, bots or automation to earn AFK credits, daily rewards or referrals;
- reselling, renting or giving away free resources or accounts;
- getting around resource limits, bans, rate limits or other restrictions;
- interfering with other users’ servers, or with our infrastructure, panel or APIs;
- accessing data, accounts or servers that aren’t yours.
We may investigate suspected violations and remove content, suspend servers or terminate accounts without notice when we believe it’s necessary to protect the Service, our users or others. We may also report illegal activity to the authorities.
8. Your content
- You own your content. Files, code, worlds, configurations and other content you put on Schokr remain yours.
- Our permission to host it. You give us permission to store, copy, process and transmit your content only as needed to run, secure and improve the Service and to follow the law.
- Your responsibility. You’re responsible for your content and for having the rights to use it. We don’t review content before it’s hosted, but we may remove anything that breaks these Terms or the law.
- Backups. Backups and snapshots are provided as a convenience. Keep your own copies of anything important. We aren’t responsible for lost data.
9. Third-party software and services
Servers run third-party software such as Minecraft, Steam games, Pterodactyl, Discord libraries and open-source packages. Your use of them is subject to their own licenses and terms, including Mojang’s Minecraft EULA, Valve’s terms and Discord’s Terms of Service. Linking Discord to Schokr is also subject to Discord’s terms. We aren’t responsible for third-party software or services.
10. Copyright complaints
If you believe content on Schokr infringes your copyright, send a notice to legal@schokr.gg with:
- Your name, address, phone number and email.
- A description of the copyrighted work.
- Where the infringing material is on Schokr, in enough detail for us to find it.
- A statement that you believe in good faith the use isn’t authorized by the owner, its agent or the law.
- A statement, under penalty of perjury, that your notice is accurate and that you’re the owner or authorized to act for them.
- Your physical or electronic signature.
We may remove the material and, where appropriate, terminate repeat infringers.
11. Suspension and termination
- By you. You can stop using the Service at any time. To delete your account and its data, email legal@schokr.gg from the email address on your account.
- By us. We may suspend or terminate your account, teams or servers if you breach these Terms, if required by law, if your use creates risk or legal exposure for us, or if we stop offering the Service.
- What happens then. When an account is terminated, servers, files, backups, snapshots, credits and upgrades may be deleted and can’t be recovered. Credits and upgrades have no cash value and aren’t refunded on termination for breach of these Terms.
12. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and that the Service will be secure, accurate, available or free of errors or data loss.
13. Limitation of liability
To the fullest extent allowed by law, Schokr and its officers, employees and partners won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Service or these Terms.
Our total liability for any claim related to the Service or these Terms is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) US $50.
Some jurisdictions don’t allow some of these limits, so they may not all apply to you.
14. Indemnity
You agree to defend and indemnify Schokr against claims, losses and costs (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms or the law.
15. Governing law and disputes
These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Santa Clara County, California, and you and Schokr consent to their jurisdiction. Nothing in this section limits rights you have under the mandatory consumer laws of the place you live.
16. Changes to these Terms
We may update these Terms. We’ll post the new version here with a new “last updated” date and, for material changes, give notice through the Service or by email. If you keep using the Service after changes take effect, you accept the updated Terms.
17. General
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and Schokr about the Service.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. Not enforcing a part of these Terms isn’t a waiver of our right to do so later.
- Assignment. You can’t transfer your rights under these Terms. We may transfer ours, for example as part of a merger or acquisition.
